Arbitration for Engineers, Technical Professionals & Contractors (rerun36) |
Given the size, scope and increasing complexities of
building engineering construction projects, there are bound to be claims &
disputes between owners of projects, engineers, contractors and other
stakeholders. Certainly, in the interests of harmonious long term
relationships, the disputing parties must pull all stops to come to amicable
settlements by themselves or through mediation.
As disputes
often involve multiple parties with divergent interests, risks and expectation,
the disputants are unable to resolve
their difference or disputes themselves or through mediation or they come to a
deadlock. As such, the disputing parties will require intervention of an
independent third party and refer their dispute to the court or to arbitration
as there must be a finality to resolve their disputes.
Since all the three main standard forms of contract in
Singapore and also, most international standard forms stipulate Arbitration as
the final dispute resolution process, it is pertinent for PEs, Engineers,
Architects, Employers, Project Managers, Technical Professionals, Contractors,
etc to have a knowledge of Arbitration. This course is therefore timely and
handy in achieving this.
